02. Lasting Power of Attorney

What is a Lasting Power of Attorney?

A lasting power of attorney (LPA) is a legal document that gives some they trust the authority to manage their affairs.

If you became unable to make decisions for yourself in the future, someone will need to make decisions for you.

Giving someone a power of attorney means that you give another person(s) the right over your financial affairs and/or care & welfare. There are two types of LPA, one called 'Property and Affairs' and one called 'Health and welfare' and to be effective these need to be completed and registered with the Office of Public Guardian (OPG).

Why is completing LPAs so important?

If you lose mental capacity and unable to your own decisions, those you trust, either partner or close family members, won't automatically be able to make decisions for you.

If you don't complete a LPA, then a court will appoint a deputy to make decisions for you on healthcare and finances, this could incur considerable cost.
